01Acceptance of these terms

These Terms & Conditions ("Terms") are a binding agreement between you and Radiatova, a brand of The Nelson M Group LLC ("Radiatova," "we," "us"). They govern your use of radiatova.com and related services, including email and text-message programs (the "Services"). By using the Services or submitting a form, you agree to these Terms, our Privacy Policy, and, if you opt in to texts, our SMS Terms. If you do not agree, do not use the Services.

02What Radiatova is, and is not

Radiatova is an information service. We publish general, plain-language information about how insurance works, how to read a policy, and what tends to affect insurance costs, and let visitors opt in to related updates. We will not sell insurance, give quotes, rates, or price estimates, match people with agents or insurers, or refer people to providers, and we will not share your details with agents, insurers, or other third-party partners.

• Decisions about your insurance are yours. Reading our content does not obligate you to do anything.
• Your own insurer or agent, not Radiatova, explains the terms, limits, exclusions, and costs of any policy, and is responsible for your coverage.
• Costs, coverage, and savings vary by person, plan, and location. We will not guarantee that you will save any amount, qualify for any coverage or discount, or get any particular result.

03Eligibility

You may use the Services only if you are 18 or over, are in the United States, and are able to agree to a binding contract. Information you submit must be about you, or about a person who has authorized you to submit it.

04Your information and accuracy

Please keep the details you give us correct and current. Enter a mobile number only if you own it or are authorized to use it. If your number changes or is reassigned, please reply STOP from the old number or contact us so that we do not message someone else.

05Communications and text-message consent

Opting in means you agree to hear from us by email and, for the boxes you check, by automated texts as explained in the SMS Terms. Consent to texts is optional, is not a condition of purchase or of using the Services, and may be withdrawn at any time by replying STOP. Message frequency varies. Message and data rates may apply. 06Text messaging: rates, frequency, STOP and HELP

Message and data rates may apply. Message frequency may vary (up to about 8 messages a month, depending on the topics you choose). Text START to join, or opt in with the form on our Get Started or text updates page. Consent is not a condition of purchase or of using the Services.

• STOP: Reply STOP to any message to opt out (STOPALL, UNSUBSCRIBE, CANCEL, END and QUIT also work). You will get one confirmation text and then no more messages.
• HELP: Reply HELP to any message for help, or contact us by email at [email protected] or by phone at 877-550-3935.

Mobile information and opt-in data are not sold or shared with third parties or affiliates for marketing or promotional purposes. See the Privacy Policy and SMS Terms.

07Acceptable use

Prohibited conduct includes: (a) false, misleading, or third-party information; (b) unlawful, fraudulent, or abusive use; (c) interference with the Services or unauthorized access attempts; (d) bots or automated form submission; (e) copying, scraping, or reselling content without permission; and (f) impersonation. We can suspend or end your access if you engage in any of it.

08Third-party organizations and links

Organizations, programs, and products mentioned on or linked from the Services (say state insurance departments, consumer groups, or insurers) are operated by third parties. We do not endorse any product, plan, or provider, and we are not responsible for what those third parties do, publish, or deliver. Your relationship with an insurer or agent is between you and them.

09Intellectual property

The Services, including the Radiatova name, logo, text, graphics, and design, are held by us or our licensors and are protected by intellectual property laws. We give you a limited, revocable, non-exclusive, non-transferable license for personal, non-commercial viewing and use of the Services. Photos on the Site carry their own free-use licenses.

10Disclaimers

No warranties of any kind, express or implied, apply to the services or content, which are supplied "as is" and "as available." This includes implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We also do not warrant that the services will be uninterrupted, error-free, or secure, or that any message will be delivered on time or at all.

Radiatova does not supply insurance, legal, or financial advice, and makes no representation about any policy, coverage, price, savings amount, or claim outcome.

11Limitation of liability

To the fullest extent permitted by law, Radiatova and The Nelson M Group LLC, and their members, managers, officers, employees, and agents, cannot be held liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, in connection with your use of (or inability to use) the services or any insurance decision you make or do not make. Our total liability on any claim relating to the services shall not exceed one hundred U.S. dollars ($100).

In jurisdictions that do not allow certain limitations, those limitations may not apply to you. These Terms never limit liability that the law says cannot be limited.

12Indemnification

You shall indemnify and hold harmless The Nelson M Group LLC and its affiliates and personnel from all claims, damages, and expenses (among them reasonable attorneys' fees) arising from violating these Terms, misusing the Services, or providing a phone number or other data without authorization.

13Disputes, governing law, and arbitration

Informal resolution first. Start by writing to us at [email protected] and give us 30 days to try to resolve it.

Binding arbitration. Apart from small-claims matters and injunctive-relief claims over intellectual-property misuse, every dispute between you and Radiatova or The Nelson M Group LLC arising from or relating to these Terms or the Services shall be resolved through final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. At your choice, the arbitration is held in your county of residence or by video or phone. An arbitrator may award the same individual relief as a court, and judgment on the award may be entered in any court with jurisdiction.

Class-action waiver. Subject to applicable law, you and Radiatova agree to proceed only on individual claims and give up the ability to participate as a plaintiff or class member in any class, collective, or representative action.

Opt-out. You can opt out of arbitration within 30 days of your first acceptance of these Terms by emailing [email protected] using the subject line "Arbitration Opt-Out" and giving your name and mobile number.

Governing law. Governing law: the Federal Arbitration Act and the laws of the state in which The Nelson M Group LLC has its principal place of business, without regard to conflict-of-law rules. Except as the arbitration clause supplies, exclusive jurisdiction lies with the state and federal courts based in that state.

14Termination

You may stop using the Services at any time, and may opt out of messages by replying STOP. We may suspend or terminate access at our discretion, including for violations of these Terms. Sections that by their nature should survive (including disclaimers, limitation of liability, indemnification, and disputes) will survive termination.

15Changes

Updates to these Terms will be posted with a new "Last updated" date. Using the Services after the effective date means accepting the updated Terms. If a change is material, we will notify you as mandated by law.

16General

You and we agree that these Terms, together with the Privacy Policy and SMS Terms, are the complete agreement on this subject. If any part cannot be enforced, the rest stays in effect. A waiver only occurs if we say so; failing to enforce is not one. You may not assign these Terms without consent, and we may assign them in a merger or sale.
